Assam Cabinet Approves Framework to Curb Illegal Infiltration

Guwahati, September 09, 2025: The Assam Cabinet has approved a Standard Operating Procedure (SOP) to remove illegal immigrants from the state. The SOP, framed under the Immigrants (Expulsion from Assam) Act, 1950, will guide Deputy Commissioners (DCs) and Senior Superintendents of Police (SSPs) in identifying and expelling illegal immigrants.

If the police or any authority inform the DC about a suspected illegal immigrant, the person must show citizenship proof within 10 days. If the evidence is not convincing, the DC will declare the person an illegal immigrant. The decision will be based on a written statement of facts and reasons.

The DC can issue an expulsion order under Section 2(a) of the Act, giving the migrant 24 hours to leave Assam. The route and manner of removal will also be specified. If needed, further orders may be issued under Section 2(b).

For Declared Foreign Nationals (DFNs) identified by Foreigners Tribunals, no fresh proof is needed. The DC will issue an expulsion order since legal remedies at higher courts may already be exhausted.

Once an immigrant is identified and ordered to leave, the DC will refer them to the SSP. The SSP will record biometrics and demographic details on the Foreigners Identification Portal.

If the person fails to comply, the DC, with SSP support, will place them in a Holding Centre or hand them over to the Border Guarding Force. Illegal immigrants caught near the border or within 12 hours of entry will be pushed back immediately without further process.
